  20th Century Fox has been working on a "Daredevil" reboot with David Slade (30 Days of Night) with plans of going into production before October 10th, which is when the franchise contractually reverts back to Marvel. The studio was all set to beat that deadline, but then Slade dropped out and now Fox feels that it has no chance of getting the new film off the ground in time.
But Fox doesn't want to just give the franchise back, especially now that Joe Carnahan (The Grey) is interested in directing. So there are now talks with Marvel to figure out how to hold on to "Daredevil."
According to Variety, Marvel is willing to extend the deadline as long as Fox gives back the rights to "Fantastic Four," including the Silver Surfer and Galactus, which is rumored to play a key role in a future Marvel movie.
But Fox is currently in the works on a "Fantastic Four" reboot with "Chronicle" helmer Josh Trank. This means that the studio will either be losing "Daredevil" or "Fantastic Four" characters. Stay tuned.

How do you figure? Sounds like FOX is meeting their contractual obligations to Marvel, then.
Anyway, one can hope. FOX has done nothing but f*ck up pretty much every comic book property they've 'developed'. Hopefully, The Punisher will also return to Marvel and be properly rebooted.

Fox is pretty much screwed. Either lose Daredevil or give up a big portion of the cool factor about Fantastic Four. Heck, I want a silver sufer movie.

Which one to drop? Depends on the budget....
If they're broke, I'd put Daredevil into production with filming one dressed up hero fighting criminals with court settings, real exteriors, cutting down costs...
If they got a pretty penny saved, pickup F. Four. More aimed at family adventure with iconic costumes & potentially epic stories using high levels of CG/ SFX with flames, the thing, "being invisable", & they're villain of Inhumans, The Negative Zone or Dr. Doom...the list is endless...
So, as everything else, it's all about the money...

In a better world neither studio would get control of these characters, and instead a studio with integrity and artistic merit (they don't exist) would handle both franchises. I would focus on a well written structured court thriller/action type hybrid with Daredevil. Meanwhile focusing on a truly fearless Silver Surfer two part saga. f*ck Fantastic Four..at least for the next few years.

Please check your sources. Fox can't give away what they don't own. The Fantastic Four movie rights are with the small German company Constantin Film and all FF movies were cooperations between Fox and Constantin. In addition, most other reports to the topic talk about characters, just characters like Galactus or Silver Surfer, not the entire FF movie rights.
