Marvel and DC Sue Comic Book Artist for Using the Word "Superhero"Posted: February 3rd, 2013 by WorstPreviews.com Staff

  Marvel and DC own properties that have brought in billions of dollars, so expect a lawsuit if anyone attempts to use their comic book characters without permission. But now comes word that the two companies are suing an independent comic book artist, Ray Felix, for naming his comic book "A World Without Superheroes."
The problem is the word "superheroes," because apparently Marvel and DC jointly filed a trademark for the term. "I had heard in 2006 that Marvel and DC had jointly renewed their trademark on the word 'Superhero,'" said Felix. "Even still, jointly trademarking a word does not entitle any company or individual rights over the word."
Marvel and DC sent their lawyers after Felix, who has attempted to prove many times that he's legally allowed to use the word. Unfortunately, it's been a difficult battle, being the little guy. Because of that, he hopes that fans and other comic book creators would join his struggle, but nobody seems to care.
"I went public about the case at the last Mocca Con. I got a few snickers and a few childish responses from so-called male adults," he explained. "It surprised me that people who spend their money at comic [conventions] and read about heroes are so afraid and un-heroic in their own code to stand for something. They're conditioned puppets of corporate structures."

Broken City was ok. Good acting and good script but very little action, It goes a lil' too heavy on the politics and it drags cuz of it. I wouldn't watch it again.

Just as a consortium of Swiss knife manufacturers trademarked the phrase "Swiss Army knife", DC and Marvel have since the 1960s owned the trademark "superhero" and some variations.
So you can write a story with a Swiss Army knife, draw one, or create a box for your kitchen knife that mentions it's better than a Swiss Army knife. But you can't claim a trademark on "Swiss Army knife" or sell a knife called "Better Than A Swiss Army Knife."
Nor can you publish a comic called "Superheroes" or even "A World Without Superheroes." This doesn't mean they can't use the word in the comic or in a review or this article, but don't use it as your brand name. Got it?

I should add that if Felix can totally invalidate Marvel & DC's trademark he'll win. But DC and Marvel will rain lawyers on the courthouse like hail to stop that from happening. He might have a case, but I don't know if he can afford the legal help to do it.
If he doesn't have the free cash to do that, his legal goose is cooked. He can't trademark "Obviously Not Kleenex" facial tissues even though some people call any facial tissue a "kleenex".
